Raising The Age To 21….

So I keep hearing the same gun controllers who point to the militia clause of the Second Amendment, insisting that the right to keep and bear arms is limited to membership in the militia, then turn around and argue that the minimum age to buy a firearm should be raised to 21.  Such individuals demonstrate their ignorance with such arguments.

Founder Tench Coxe, when addressing questions regarding the composition of the militia, responded, “The powers of the sword are in the hands of the yeomanry of America from sixteen…”


Sixteen, not 21.


Ok, but he was just an individual Founder.


So let’s consider what the law says: 

“10 U.S. Code § 246 - Militia: composition and classes

“(a) The militia of the United States consists of all able-bodied males at least 17 years of age…”

17, not 21.


So if they are going to claim that the Militia clause determines who may own a firearm, then they must also accept that the law establishes a minimum age of 17 to own and possess firearms, as all citizens who are at least 17 are declared to be members of the unorganized militia.


BTW, Michigan law also established a minimum age of 17 for militia duty:

“MCL 32.509 State military establishment; composition; organized and unorganized militia.

“Sec. 109.

“The organized militia of this state taken collectively shall be known as the state military establishment and constitutes the armed forces of this state…. The unorganized militia consists of all other able-bodied citizens of this state and all other able-bodied citizens who are residents of this state who have or shall have declared their intention to become citizens of the United States, who shall be age 17 or over…”

In both instances, federal and state Constitutions, membership in the unorganized militia isn’t voluntary, the law declares membership to be a citizen duty.  If you are a citizen and at least 17 years old, YOU ARE A MEMBER OF THE MILITIA.  As such, the minimum age to own/bear (possess/carry) a firearm is 17.

Full Text Of The Email Sent By ISIS To The Parents Of James Foley...

Before killing James Foley, ISIS sent the following email to his parents:
"HOW LONG WILL THE SHEEP FOLLOW THE BLIND SHEPPARD?
A message to the American government and their sheep like citizens:
We have left you alone since your disgraceful defeat in Iraq. We did not interfere in your country or attack your citizens while they were safe in their homes despite our capability to do so!
As for the scum of your society who are held prisoner by us, THEY DARED TO ENTER THE LION’S DEN AND WHERE EATEN!
You were given many chances to negotiate the release of your people via cash transactions as other governments have accepted,
We have also offered prisoner exchanges to free the Muslims currently in your detention like our sister Dr Afia Sidiqqi, however you proved very quickly to us that this is NOT what you are interested in.
You have no motivation to deal with the Muslims except with the language of force, a language you were given in “Arabic translation” when you attempted to occupy the land of Iraq!
Now you return to bomb the Muslims of Iraq once again, this time resorting to Arial attacks and “proxy armies”, all the while cowardly shying away from a face-to-face confrontation!
Today our swords are unsheathed towards you, GOVERNMENT AND CITIZENS ALIKE! AND WE WILL NOT STOP UNTILL WE QUENCH OUR THIRST FOR YOUR BLOOD.
You do not spare our weak, elderly, women or children so we will NOT spare yours!
You and your citizens will pay the price of your bombings!
The first of which being the blood of the American citizen, James Foley!
He will be executed as a DIRECT result of your transgressions towards us!"

They still claim that they defeated us in Iraq, and they have stated their thirst for our blood.

Anyone who still believes this is a group with which we can negotiate is seriously deluded.

To the citizen militia, which, according to the original definition includes all able bodied males between the ages of 17 - 60, I say, it is time to prepare.  They threaten to bring war to our cities.

This is one of the reasons for which the citizen militia exists.  As Albert Gallatin observed, "A militia is everywhere; whereas a standing army may be very distant from any attack which may take place."

We will be on the front lines should they choose to make good on their threat.

Posse Comitatus and Border Security...

"It is time to rescind the existing Posse Comitatus Act and replace it with a new law. The old law is widely misunderstood and unclear. It leaves plenty of room for people to do unwise and perhaps unlawful things while trying to comply with their particular version. It certainly does not provide a basis for defining a useful relationship of military forces and civil authority in a global war with terrorism. The Posse Comitatus Act is an artifact of a different conflict-between freedom and slavery or between North and South, if you prefer. Today's conflict is also in a sense between freedom and slavery, but this time it is between civilization and terrorism. New problems often need new solutions, and a new set of rules is needed for this issue.
President ... and Congress should initiate action to enact a new law that would set forth in clear terms a statement of the rules for using military forces for homeland security and for enforcing the laws of the United States. Things have changed a lot since 1878, and the Posse Comitatus Act is not only irrelevant but also downright dangerous to the proper and effective use of military forces for domestic duties." Col. Regardless of your position on illegals, it cannot be denied that the situation on our border with Mexico has gotten seriously out of hand. The violence has escalated to unprecedented levels, and is making further inroads into our nation. Incursions like those initiated recently by Mexican soldiers, who ventured onto US soil for the purpose of removing evidence from a crime scene implicating one of their citizens, driving off FBI agents who were investigating that scene in the process, cannot be tolerated. The video from that day clearly showed that it was OUR territorial integrity that was violated, not the other way around.

It is said that fences make good neighbors. Whether physical or abstract, clearly defined and defended borders have the same effect.

Until Posse Comitatus is replaced by another guideline that makes more sense in this day and age, the Army and Air Force will continue to be governed by it unless waived by the President. However, according to Col. Brinkerhoff, the Marine Corps and National Guard are NOT limited by Posse Comitatus ("Does not apply to the Navy and Marine Corps. However, the Department of Defense has consistently held that the Navy and Marine Corps should behave as if the act applied to them. Does not apply to the National Guard in its role as state troops on state active duty under the command of the respective governors. May not apply to the National Guard (qua militia) even when it is called to federal active duty. The Posse Comitatus Act contains no restrictions on the use of the federalized militia as it did on the regular Army."). According to Major Craig T. Trebilcock, Judge Advocate General Corps, U.S. Army Reserves, "...one of the express missions of the Guard is to preserve the laws of the state during times of emergency when regular law enforcement assets prove inadequate." If we are unable, or lack the political will, to defend our own borders and territorial integrity, then we have no business sending our troops around the world to die for the integrity of the borders of another country. It is time to release the Guards to, at the very least, perform the duties for which they were expressly created.

Like charity, defense begins at home.
